Please read these Terms carefully before using the Send My CV service. By sending a message to our WhatsApp number, you agree to be bound by these Terms. If you do not agree, please do not use the service.

1. About Send My CV

(registration number ), trading as Send My CV, operates a free WhatsApp-based CV-building service for job seekers in South Africa. These Terms & Conditions ("Terms") govern your use of the service.

References to "we", "us", or "the Company" mean . References to "you" or "user" mean the person using the service.

2. Who may use the service

You may use Send My CV only if:

  • You are at least 18 years of age
  • You are using the service for your own personal CV (not on behalf of another person without their consent)
  • You have a valid WhatsApp account and accept WhatsApp's own Terms of Service
  • The information you provide is true, accurate, and your own

If you are under 18, you may not use this service. If we become aware that a person under 18 has used the service, we will delete their data promptly.

3. What the service does

Send My CV allows you to build a professional CV through a guided WhatsApp conversation. You answer questions about your education, work experience, skills, and personal details. We use this information to generate a formatted PDF CV, which we send back to you on WhatsApp.

The service is provided free of charge. Standard WhatsApp data costs may apply depending on your mobile data plan — we are not responsible for any data costs you incur.

We use artificial intelligence tools (including Google Gemini and Groq) to assist with improving the quality of your CV text, such as correcting spelling, enhancing job descriptions, and generating profile statements. All AI-generated text is presented to you for review and approval before it appears on your CV.

We also offer an optional Interview Practice feature, where you can rehearse interview questions by sending voice notes and receive automated AI-generated feedback. This feature is described in clause 16.

4. Your content

4.1 Ownership

You retain ownership of all personal information and content you provide to the service. Your CV belongs to you. We do not claim any intellectual property rights over the content of your CV.

4.2 Licence to process

By using the service, you grant us a limited, non-exclusive licence to store, process, and use your content solely for the purpose of generating your CV, giving you interview-practice feedback, and operating the service. This includes processing any voice notes you send to the Interview Practice feature in order to transcribe them — we do not store the audio recordings themselves, only the resulting text transcript (and only with your consent). This licence ends when you delete your data (by sending RESTART).

4.3 Accuracy

You are responsible for ensuring that all information you provide is accurate and truthful. We do not verify your qualifications, employment history, or any other information you submit. This includes the names, contact details, and consent status of any references you list. Adding a person as a reference without obtaining their actual consent — including by misusing the reference invite link — is your responsibility. Providing false information on a CV may be unlawful and is entirely your responsibility.

4.4 Aggregated data

We may use anonymised, aggregated insights derived from CV data (such as common skill categories across South Africa) to improve the service and for research purposes. No individual user is identifiable in this analysis.

5. Our intellectual property

The Send My CV name, logo, website, application code, CV templates, and all related intellectual property are owned by or licensed to . You may not copy, reproduce, distribute, or create derivative works from any part of our service without our prior written consent.

6. Acceptable use

You agree not to use the service to:

  • Provide false, fraudulent, or misleading information
  • Impersonate another person
  • Build a CV on behalf of another person without their knowledge and consent
  • Submit references without that person's knowledge and consent, or fabricate the identity, role, or contact details of a reference
  • Record or submit a voice note containing another person's voice, or any unlawful, confidential, or harmful audio content
  • Attempt to disrupt, hack, or interfere with the service or its underlying systems
  • Use automated tools, bots, or scripts to interact with the WhatsApp service other than through normal WhatsApp use
  • Send spam or unsolicited messages through the service
  • Use the service for any unlawful purpose or in violation of South African law

We reserve the right to suspend or terminate access for any user who breaches these restrictions, without prior notice.

7. Privacy and data protection

Your use of the service involves the processing of your personal information. Our Privacy Policy explains how we collect, use, store, and protect your information, and sets out your rights under the Protection of Personal Information Act 4 of 2013 (POPIA).

By using the service, you consent to the processing of your personal information as described in our Privacy Policy. You may withdraw consent at any time by sending RESTART on WhatsApp, which will permanently delete your data.

Our website uses Microsoft Clarity analytics cookies to help us understand how visitors use the site. This cookie is only set with your explicit consent via the banner shown on your first visit. You may decline or withdraw consent at any time by clearing your browser cookies. No CV content or WhatsApp data is shared with Microsoft Clarity.

8. Service availability

We aim to keep the service available at all times but cannot guarantee uninterrupted access. The service may be temporarily unavailable due to:

  • Scheduled or emergency maintenance
  • WhatsApp or Meta platform outages
  • Events beyond our reasonable control (force majeure)

We will not be liable for any losses arising from service unavailability. We reserve the right to modify, suspend, or discontinue the service at any time with reasonable notice to active users.

9. No guarantee of employment

Send My CV provides a tool to help you create a professional CV. We make no representation or guarantee that:

  • Using our service will result in you obtaining employment
  • Your CV will meet the requirements of any specific employer
  • The CV template or content suggestions provided are suitable for every industry or role

You use the service and any CV produced by it at your own risk and discretion.

10. Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

AI-generated suggestions, CV content improvements, and interview-practice feedback are provided as a convenience tool. We do not guarantee that AI-generated text or feedback is accurate, appropriate, or free from errors. You are responsible for reviewing and approving all content before your CV is finalised.

We do not warrant that the service will meet your specific requirements or that it will be error-free, secure, or uninterrupted.

11. Limitation of liability

To the maximum extent permitted by South African law, and its directors, employees, and contractors shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, goodwill, or business opportunities
  • Any harm resulting from reliance on AI-generated content in your CV or on AI-generated interview-practice feedback
  • Any harm resulting from errors, inaccuracies, or omissions in your CV
  • Losses arising from WhatsApp or Meta platform failures

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the service shall not exceed R500.00.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under South African law, including the Consumer Protection Act 68 of 2008 where applicable.

12. Indemnity

You agree to indemnify and hold harmless and its directors, employees, and contractors from and against any claims, losses, damages, and expenses (including legal fees) arising from:

  • Your breach of these Terms
  • False or inaccurate information you provided through the service
  • Your violation of any third party's rights
  • Any unlawful use of the service by you

13. WhatsApp and Meta

Our service is delivered over WhatsApp, a platform operated by Meta Platforms Ireland Limited. Your use of WhatsApp is subject to WhatsApp's Terms of Service and Privacy Policy. We are not affiliated with, endorsed by, or a partner of Meta Platforms Inc. or WhatsApp.

We cannot be held responsible for WhatsApp outages, changes to WhatsApp's platform, or Meta's decisions to restrict or modify the WhatsApp Business API in ways that affect our service.

14. Suspension and termination

You may stop using the service at any time. Send RESTART on WhatsApp to delete all your data, or simply stop messaging us.

We may suspend or permanently terminate your access to the service, without prior notice, if you breach these Terms or if we are required to do so by law. Where termination results in deletion of your data, we will make reasonable efforts to notify you via WhatsApp first.

15. Job Listings Service

15.1 Nature of the service

Send My CV provides a job listings feature that displays employment opportunities sourced from third-party employers and job platforms. Send My CV operates solely as an aggregator of job listings and is not a recruitment agency, employment agency, or party to any employment relationship or application process.

15.2 Third-party listings

All job listings displayed through the Send My CV service are sourced from third parties. Send My CV does not create, verify, endorse, or guarantee the accuracy, completeness, legality, or availability of any job listing. Job listings are displayed for informational purposes only.

15.3 No employment guarantee

Send My CV makes no representation or warranty that any job listing will result in an interview, offer of employment, or placement. The outcome of any application submitted by a user is solely a matter between the user and the relevant employer.

15.4 Disclaimer of liability

To the fullest extent permitted by applicable South African law, , trading as Send My CV, accepts no responsibility or liability for:

  1. the accuracy, truthfulness, currency, or completeness of any job listing;
  2. the legitimacy or authenticity of any employer or job listing, including fraudulent, misleading, or scam listings posted by third parties;
  3. any loss, harm, financial damage, identity theft, or personal injury suffered by a user arising from reliance on any job listing or from applying for any position displayed through the service;
  4. any failure by an employer to respond to, acknowledge, or process any application submitted by a user;
  5. the expiry, removal, or unavailability of any job listing at the time a user attempts to apply.

15.5 User responsibility

Users are solely responsible for independently verifying the legitimacy of any job listing before applying. Users are reminded that legitimate employers in South Africa do not require applicants to pay any registration fee, training fee, uniform fee, or any other upfront payment as a condition of employment or application. If any listing requests such payment, users should treat it as a potential scam and report it to Send My CV immediately.

15.6 Scam awareness

Send My CV takes reasonable steps to identify and remove fraudulent listings but cannot guarantee that all listings are legitimate. Users are encouraged to report any suspicious listing by contacting hello@sendmycv.co.za. Send My CV will investigate and remove listings reported as fraudulent as soon as reasonably practicable.

15.7 Click tracking

When a user taps a job listing link through the Send My CV service, the user's interaction is recorded for the purpose of improving job matching and measuring service quality. This tracking is carried out in accordance with Send My CV's Privacy Policy and the consent provided by the user prior to accessing the job listings feature. No personally identifiable information is shared with any employer as a result of a user tapping a job listing link.

15.8 Application process

Users apply for jobs directly on the employer's own platform or website. Send My CV is not involved in and accepts no responsibility for the employer's application process, hiring decisions, data handling practices, or any communications between the employer and the user following an application.

15.9 Consent

By using the job listings feature, users confirm that they have provided their consent as requested prior to accessing the feature and that they understand the nature of the service as set out in this clause.

16. Interview Practice

16.1 Nature of the feature

Interview Practice is an optional feature that lets you rehearse common interview questions. You reply to questions by sending a WhatsApp voice note, which we transcribe into text and analyse using artificial intelligence to give you practice feedback (for example, on the structure and clarity of your answer and your overall readiness). It is a self-help practice tool only.

16.2 Not professional advice

The feedback is generated automatically and is provided for general practice purposes only. It is not professional, career, recruitment, psychological, or legal advice, and it is not an assessment by a human. We do not guarantee that the feedback is accurate, complete, or suitable for any particular interview, employer, or role, and using this feature does not improve or guarantee your chances of obtaining employment (see clause 9).

16.3 Voice notes and transcription

When you use this feature you consent to us receiving your voice note and to it being transcribed and translated into English and analysed by our AI processors (including Google Gemini and Groq) for the purpose of giving you feedback. We do not store the voice note recording itself — once it has been transcribed, the audio is discarded; only the English text transcript may be stored, and only if you consent (see clause 16.4). Please answer only in Zulu, Sesotho, Xhosa, or English. You must not record or submit any other person's voice, or any unlawful, confidential, or harmful content, in a voice note.

16.4 Storing your practice answers (with your consent)

We store the text transcript of your practice answers only if you give your consent when prompted (we never store the audio). Where you consent, these transcripts are stored pseudonymously — linked to an internal identifier, not to your name or phone number — so that we can show you progress over time and produce anonymised, aggregated insights about how the feature is used. You may withdraw this consent at any time from the Interview Practice menu; doing so stops further storage and deletes the transcripts we have stored for you. Sending RESTART also deletes them.

16.5 Practising without storage

If you choose not to consent, you can still use the feature — your answers are used only to generate your immediate feedback and are not retained for analytics.

17. Changes to these Terms

We may update these Terms from time to time. The version number and effective date at the top of this page will reflect any changes. Where changes are material, we will notify active users via WhatsApp at least 14 days before the changes take effect. Your continued use of the service after that date constitutes acceptance of the updated Terms.

18. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed from these Terms without affecting the validity and enforceability of the remaining provisions.

19. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the South African courts, without prejudice to your right to refer a consumer complaint to the National Consumer Commission under the Consumer Protection Act 68 of 2008.
